Nexxus Delta Plan Subscription Agreement
This Nexxus Delta Plan Subscription Agreement (“Agreement”) governs enrollment in the Nexxus Delta Plan (“Delta Plan”), a recurring subscription service offered by Oasis Water Technologies Water Technologies, Inc. (“Oasis Water Technologies Water Technologies,” “we,” “our,” or “us”). By enrolling in the Delta Plan, you (“Customer,” “you”) agree to the terms below. This Agreement supplements and incorporates by reference Oasis Water Technologies Water Technologies’s Terms of Sale, Privacy Policy, and Nexxus Installation, Operation & Warranty Agreement.
1. Eligibility
The Delta Plan is available only to Nexxus system owners. Enrollment requires an active Nexxus system associated with your Oasis Water Technologies Water Technologies account.
2. Subscription Term & Billing
The Delta Plan is a monthly subscription billed at $55 per month. Billing begins immediately upon enrollment. The subscription automatically renews on a month-to-month basis unless canceled. No Proration. Subscription fees are billed in full monthly increments and are not prorated, refunded, or credited.
3. Minimum Commitment
Enrollment requires a minimum commitment of three (3) months. If canceled before completion, Oasis Water Technologies Water Technologies will immediately charge the remaining unpaid months. After settlement, the subscription terminates with no further charges.
4. Cancellation
Cancellation is available after the minimum commitment via account dashboard, email support, or live chat.
5. Pricing Changes
Oasis Water Technologies may modify pricing no more than once every six (6) months with advance notice. Changes apply only to future billing periods.
6. Delta Plan Services
Services include automated filter shipments, water data insights, live alerts, free replacement batteries, O-rings, sump wrench, free shipping on Nexxus-related purchases, and tree planting funded by Oasis Water Technologies.
7. Automation & Shipment Timing
Shipments are best-effort and subject to availability, logistics, and data conditions. Oasis Water Technologies may recommend alternative filter packs.
8. Water Data & Monitoring Disclaimer
Data is sourced from public EPA databases and Oasis Water Technologies interpretation. No guarantees are made regarding accuracy or water quality outcomes.
9. No Health or Medical Guarantee
The Delta Plan does not provide medical, health, or safety guarantees.
10. Free Items Clarification
Replacement items are provided only for normal wear and tear during an active subscription and have no cash value.
11. App & Notification Responsibility
Customers are responsible for installing and enabling the Oasis Water Technologies mobile app and responding to alerts.
12. Geographic & Regulatory Limitations
Services may vary based on geographic or regulatory factors.
13. Force Majeure
Oasis Water Technologies is not liable for delays or failures due to events beyond reasonable control.
14. Relationship to Warranty
The Delta Plan does not modify or extend the Nexxus system warranty.
15. Suspension or Termination
Oasis Water Technologies may suspend or terminate service for misuse, fraud, or violations.
16. Limitation of Liability
Services are provided as available without liability for indirect or consequential damages.
17. Governing Law & Dispute Resolution
Delaware law and arbitration provisions apply.
18. Acceptance
By enrolling, you acknowledge and agree to these terms.
